SECTION 1: ONLINE STORE TERMS

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age, or that you are of legal age in your country of residence and have given us your consent to allow any minor dependants in your care to use this website.

You may not use our products for any illegal or unauthorised purpose, and you may not violate any laws in your jurisdiction when using our services. You must not transmit any viruses or any code of a destructive nature. A breach of any of these terms will result in the immediate termination of your access to our services.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including payment card information) may be transferred unencrypted and may involve transmission over various networks and changes to meet the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of our website, its content or our services without our express written permission.

From time to time there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges and delivery times. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order. If an order is cancelled for this reason and payment has already been made, you will receive a full refund.

SECTION 4: PRODUCTS AND PRICES

Koruwins offers women's clothing, including tops, sweaters, jackets, coats and matching sets.

We take great care to show the colours and details of our products as accurately as possible. However, we cannot guarantee that your screen will display every colour exactly as it appears in real life, and small differences in shade or texture may occur.

All prices are shown in euros (EUR) and include the applicable VAT. Shipping costs, where applicable, are shown separately during checkout before you place your order. Prices are subject to change without notice, but any change will not affect orders that have already been confirmed.

We reserve the right to limit the quantities of any product we offer and to discontinue any product at any time. Any offer for any product on this site is void where prohibited.

SECTION 5: ORDERS AND CONTRACT

The presentation of products on our website is not a legally binding offer but an invitation to place an order. By completing checkout, you submit a binding offer to purchase the selected items. You will then receive an email confirming that we have received your order. A contract is formed once we confirm your order or dispatch the goods.

We reserve the right to refuse or cancel any order, for example in the case of suspected fraud, incorrect pricing or limited stock. If we cancel an order after payment has been made, we will refund the full amount to your original payment method.

You agree to provide current, complete and accurate purchase and account information for all purchases made in our store, and to update your details promptly, including your email address and delivery address, so we can complete your order and contact you when needed.

SECTION 6: PAYMENT

Payment is made using one of the payment methods offered at checkout. Your order will only be processed once payment has been successfully authorised. All payments are handled through secure, encrypted payment providers, and we do not store your full card details on our servers.

SECTION 7: SHIPPING AND DELIVERY

We currently ship to addresses in Germany only. All orders are dispatched from Germany.

We offer two shipping options:

Free Standard Shipping: free of charge, with an estimated delivery time of 4 to 5 business days.

Insured Express Shipping: 4.95 EUR, with an estimated delivery time of 2 to 3 business days. This option includes shipping insurance for your parcel.

Delivery times are estimates and start from the moment your order has been dispatched. Business days are Monday to Friday, excluding public holidays. While we do everything we can to deliver on time, delays caused by the carrier, high order volumes or circumstances beyond our control may occasionally occur. Once your order has been shipped, you will receive a confirmation email with tracking information.

Please make sure your delivery address is correct when placing your order. We are not responsible for delays or failed deliveries caused by an incorrect or incomplete address provided by the customer.

SECTION 8: RIGHT OF WITHDRAWAL AND RETURNS

As a consumer, you have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period begins on the day you, or a third party you have named who is not the carrier, receive the goods.

To exercise your right of withdrawal, please inform us of your decision with a clear statement by email to support@koruwins.com. Items must be returned unworn, unwashed and in their original condition with all tags attached.

Once we have received and inspected your return, we will refund all payments received from you, including the standard delivery costs, no later than 14 days after we receive your withdrawal notice. We may withhold the refund until we have received the goods back or until you have provided proof that you have sent them. The refund will be made using the same payment method you used for the original purchase.

SECTION 9: DAMAGED OR INCORRECT ITEMS

If your order arrives damaged, faulty or is not what you ordered, please contact us at support@koruwins.com as soon as possible after delivery, ideally with photos of the item and packaging. We will gladly arrange a replacement or refund. Your statutory warranty rights remain fully unaffected.

We are not responsible for examining or evaluating the content or accuracy of these websites and we do not accept any liability for their materials, products or services. We do not guarantee that your use of our service will be uninterrupted, timely, secure or free of errors. From time to time we may remove the service for indefinite periods or cancel it at any time without notice.

Our liability for damages caused intentionally or through gross negligence, as well as for injury to life, body or health, is unlimited. In cases of slight negligence, we are only liable for the breach of essential contractual obligations, and only up to the amount of damage that was foreseeable and typical for this type of contract at the time it was concluded. Liability under mandatory consumer protection laws remains unaffected.

You agree to indemnify and hold harmless Wearable B.V., its director and staff from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall still be enforced to the fullest extent permitted by law, and the unenforceable part shall be considered separate from these terms. This will not affect the validity and enforceability of the remaining provisions.

These Terms of Service remain in effect unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our services, or when you stop using our website. If we believe you have failed to comply with any term of these Terms of Service, we may terminate this agreement at any time without notice and may deny you access to our services.

SECTION 19: ENTIRE AGREEMENT

These Terms of Service, together with any policies or operating rules posted by us on this website, form the entire agreement between you and us and govern your use of our services. They replace any prior or contemporaneous agreements, communications and proposals, whether oral or written.

SECTION 20: GOVERNING LAW

These Terms of Service and any separate agreements under which we provide you services are governed by the laws of Belgium. If you are a consumer with your habitual residence in Germany, this choice of law does not deprive you of the protection granted to you by the mandatory consumer protection provisions of German law.

SECTION 21: ONLINE DISPUTE RESOLUTION

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please contact us directly at support@koruwins.com and we will do our best to find a fair solution together.
